Seller Agreement - The Grand Bazaar of Australia

Terms of Use for Commerce Services

This Seller Agreement ("Seller Terms") governs your use of the commerce services and features provided by The Grand Bazaar of Australia (the-grand-bazaar.com) to display, promote, offer, market, or sell products and services (each a "Commerce Feature") to users of the platform (each a "User").

1. Incorporation of Other Policies

These Seller Terms incorporate other relevant policies, terms, and conditions applicable to the use of The Grand Bazaar of Australia’s Commerce Features, including:

  • Compliance with all applicable terms and conditions governing commercial activities on the platform.
  • Adherence to the Commerce Policies and, if applicable, Seller Policies.
  • Compliance with any payment terms if utilizing payment features available through the platform.
  • Meeting all eligibility requirements set forth by The Grand Bazaar of Australia to access certain Commerce Features.

If conflicts arise between these Seller Terms and any other policies, the Seller Terms will govern exclusively regarding the use of Commerce Features.

2. Listings and Content

A. Permissions and License

By sharing product or service listings (“Product Listings”), you grant The Grand Bazaar of Australia a non-exclusive, perpetual, irrevocable, transferable, sublicensable, royalty-free, worldwide license to host, use, distribute, modify, display, translate, and create derivative works from your Product Listings and any other shared content, data, or media related to your commerce activities on the platform.

B. Seller Responsibilities

You are solely responsible for ensuring that all Seller Content is:

  • Accurate, complete, and up-to-date, including descriptions, pricing, applicable taxes, and shipping information.
  • Accompanied by clear terms, conditions, and policies related to transactions, returns, and privacy as required by law.
  • Compliant with all applicable tax laws. You are responsible for tax determinations, collections, and reporting related to your transactions.

3. Products and Services

  • Your products, services, and listings must comply with The Grand Bazaar of Australia’s policies and all applicable laws and regulations.
  • The sale of counterfeit or pirated goods, as well as any products restricted by government sanctions, is strictly prohibited.
  • You are responsible for managing customer service, refunds, and returns.
  • If The Grand Bazaar of Australia provides incentives (e.g., discounts or promotions), these do not modify your obligations under these Seller Terms.
  • You are solely responsible for product safety and recall compliance.

4. Commerce Services

  • The Grand Bazaar of Australia may modify or discontinue Commerce Features at any time without prior notice or liability.
  • Any tools or services provided (e.g., sales analytics, pricing suggestions, shipping rate calculators) are for convenience only and used at your own risk.
  • You may use third-party service providers only if they comply with these Seller Terms. You are responsible for their actions or omissions.
  • The platform may display ratings and reviews about you and your products. You are not entitled to ownership of this content.

5. User Data Usage

  • You may only use User Data in compliance with applicable laws, these Seller Terms, and The Grand Bazaar of Australia’s policies.
  • You may not sell or misuse User Data. Direct marketing to Users is prohibited unless they have opted in.
  • If applicable, data processing terms will govern how User Data is handled.
  • You must notify The Grand Bazaar of Australia of any data security incidents and cooperate in their resolution.

6. Enforcement of Terms

  • The Grand Bazaar of Australia reserves the right to review and take necessary actions to ensure compliance with these Seller Terms.
  • Failure to enforce any part of these terms does not waive The Grand Bazaar of Australia’s right to do so later.
  • The platform may request information from you as part of compliance reviews, and you must comply promptly.

7. Indemnification

  • You agree to indemnify The Grand Bazaar of Australia against any claims, damages, or losses related to your sale of products, tax liabilities, or breaches of these Seller Terms.
  • You assume all responsibility for tax compliance and shall not seek reimbursement for tax-related penalties or fees.

8. Additional Terms

  • If you link accounts from other platforms to The Grand Bazaar of Australia’s Commerce Features, these Seller Terms will also apply.
  • If selling to consumers in the European Union or United Kingdom, additional platform-to-business regulations may apply.
  • No partnership, franchise, or exclusive relationship is established between you and The Grand Bazaar of Australia by agreeing to these terms.
  • These Seller Terms may be updated at any time. Changes will be posted with a revised “Last Updated” date and will take effect immediately unless stated otherwise.
  • If any part of these Seller Terms is deemed unenforceable, the remaining portions will remain valid.
  • You may terminate your agreement by providing a 30-day written notice, but certain provisions will remain in effect after termination.

By continuing to use The Grand Bazaar of Australia’s Commerce Features, you agree to comply with these Seller Terms.
